1. Agreement to Terms

By accessing or using Pikaan ("the Service"), operated by Pikaan ("we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Pikaan is an AI-assisted claim review service. The Service processes text, documents, and the speech in video and audio, splits it into individual claims, and shows each claim with a provisional AI assessment and the web sources it used, for a person to review. Assessments can be incomplete or wrong. Results are provided for informational purposes only and should not be treated as legal, medical, or professional advice.

3. Accounts

To use the Service, you must create an account. You agree to:

• Provide accurate and complete registration information.
• Maintain the security of your account credentials.
• Notify us immediately of any unauthorized use of your account.
• Accept responsibility for all activity that occurs under your account.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations.
• Submit content that is unlawful, harmful, threatening, abusive, or otherwise objectionable.
• Attempt to interfere with or disrupt the Service or its infrastructure.
• Circumvent usage limits, rate limits, or credit restrictions.
• Use automated tools to access the Service without our prior written consent.

5. Credits and Billing

The Service uses a credit-based billing system:

• Account registration does not include provider-backed usage. An active paid entitlement and available credits are required before provider-backed work begins.
• Starter and Pro include credits that renew every month, on monthly and annual billing alike.
• Starter may include a free trial. A payment method is required to start it. Unless you cancel before the trial ends, the subscription starts automatically and you are charged the price shown at checkout. One free trial per customer.
• Credits cover variable model-token, web-search, speech-to-text, PDF processing, storage, and rendering costs.
• Unused credits from paid plans do not roll over to the next month.
• Usage stops before your available credit balance is exceeded. There are no automatic overage charges. You can choose to add extra credits, as described below.
• Failed or cancelled work releases its reserved credits. A completed request is settled against itemized actual usage.
• Payments are processed securely through our payment processor. Prices are in USD.

Extra credits

• Extra credits are a one-time purchase, not a subscription (currently 1,000 credits for $9.99 and 5,000 credits for $44.99).
• Extra credits never expire. They are used after your monthly credits.
• You can use extra credits while you have an active paid plan. If your plan ends, they stay on your account and can be used again when a paid plan is active.
• Extra credits are not transferable and have no cash value.
• Extra credits are paid for through our payment processor, in the same way as subscriptions.

6. Cancellation and Refunds

You may cancel your subscription at any time from your billing dashboard. Your access continues until the end of the current billing period. If you cancel during a free trial, you are not charged and access ends when the trial ends. We do not offer prorated refunds for partial billing periods. If you believe you were charged in error, contact us within 30 days. Extra credits are a one-time purchase and are not affected by cancelling your subscription. Unused credits from a purchase can be refunded on request within 14 days of the purchase; credits that have already been used cannot be refunded.

7. Intellectual Property

The Service, including its software, design, and content, is owned by Pikaan and protected by intellectual property laws. You retain ownership of content you submit for fact-checking. By using the Service, you grant us a limited license to process your content for the service-delivery, storage, security, diagnostics, and support purposes described in the Privacy Policy. This license does not transfer ownership of your content to Pikaan.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind. AI-generated fact-checking results may contain errors or inaccuracies. We do not guarantee the accuracy, completeness, or reliability of any analysis results. You should independently verify important claims before relying on them.

9. Limitation of Liability

To the maximum extent permitted by law, Pikaan shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Modifications

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive.
